Acceptable Use Policy

This Acceptable Use Policy ("Policy") outlines acceptable behavior for all users of our e-learning platform, including the digital textbook and audiobook apps, as well as our social media app. By accessing or using our services, you agree to comply with this Policy.

Your use of KMK and its Services is at all times subject to our Terms & Conditions, which incorporates this Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms & Conditions. Our Privacy Policy applies to all users of KMK and its services.

1. Purpose

The purpose of this Policy is to ensure a safe, productive, and respectful environment for all users. We are committed to fostering a community that promotes learning, collaboration, and positive interaction.

2. User Access and Software Requirements

To ensure optimal performance and accessibility of KMK's Board Prep Software and related services, users may need to adjust their device settings as follows:

KMK is not responsible for any degradation of service, partial availability, or complete inability to access KMK's website and services due to user-configured security settings or software. Additionally, KMK is not liable for any issues related to internet connectivity, Wi-Fi, cellular service, or other third-party factors that may impact the delivery or usability of KMK's website and services.

3. Prohibited Conduct

Users are prohibited from engaging in any of the following activities:

  • Obscene or Offensive Content: Posting, sharing, or distributing content that is obscene, vulgar, or offensive. This includes, but is not limited to, hate speech, harassment, or any content that targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
  • Illegal Activities: Engaging in any illegal activities, including but not limited to the distribution of copyrighted material without permission, fraud, or any form of cybercrime.
  • Impersonation: Impersonating any person or entity, including but not limited to our staff or other users.
  • Spam and Advertising: Posting unsolicited or unauthorized advertisements, promotional materials, or any other form of solicitation.
  • Disruption of Services: Engaging in activities that interfere with or disrupt the operation of our services or the experience of other users, including but not limited to introducing malware, spam, or viruses.
4. Copyright Protections

All content available on our platform, including but not limited to digital textbooks, audiobooks, and user-generated content, is protected by copyright laws and other intellectual property rights. Users may not:

  • Download, reproduce, distribute, or modify any content without obtaining explicit permission from the copyright holder.
  • Use any content for commercial purposes, including reselling or distributing materials.
5. No Downloading, Distribution, or Reselling

Users are strictly prohibited from:

  • Downloading or copying any materials from our platform for personal use, distribution, or resale.
  • Distributing, reselling, or sharing any content obtained from our platform in any format, including digital and physical copies.
  • Engaging in any activity that violates copyright or other intellectual property laws.
6. Exclusive KMK Events

We host exclusive KMK events, such as webinars, live lectures, and other educational opportunities. Any disruption or violation of our policies during these events may result in:

  • Removal from the event.
  • A ban from future events.
  • Account termination.
Termination and Non-Refundable Policies

Any termination of accounts for policy violations will not result in a refund, in full or in part. All ODPay contracts remain enforceable regardless of account status.

8. User Responsibilities

Users are responsible for their own conduct and must ensure that any content they post complies with this Policy. Users should also report any prohibited conduct they encounter while using our services.

9. Enforcement

We reserve the right to monitor user activity to ensure compliance with this Policy. Any violation of this Policy may result in the following actions, at our sole discretion:

  • Removal of offending content.
  • Temporary or permanent suspension of user accounts.
  • Reporting of illegal activities to the appropriate authorities.
10. Changes to the Policy

We may revise this Policy from time to time to reflect changes in our practices or applicable laws. Any changes will be effective immediately upon posting the revised Policy on our website. Continued use of our services after any changes constitutes acceptance of the updated Policy.

11. Jurisdiction and Arbitration

This Policy shall be governed by the laws of the State of Nebraska. Any disputes arising out of or related to this Policy shall be subject to the exclusive jurisdiction of the courts located in Nebraska. Before initiating any court proceedings, users agree to submit any disputes or claims to binding arbitration, conducted in accordance with the rules of a mutually agreed-upon arbitration organization within Nebraska.
